Food Business Operator in India is required to get an FSAAI licence or food licence under the Food Safety &Standards Authority of India. The Food Safety and Standards Authority of India (FSSAI) was established under the Food and Safety and Standards Act, under the authority of the Ministry of Health & Family Welfare, Government of India.

FSSAI

FSSAI deals with food-related issues. They lay down science-based standards. In addition, for articles of food to regulate their manufacture, storage, distribution, sale and import to ensure the availability of safe and wholesome food for human consumption.

As per Section 31(1) & 31(2) of  FSS Act, 2006 every Food Business Operator in the country is required to be licensed/registered under the Food Safety &Standards Authority of India.The licensing and registration procedure and requirements are regulated by the Food Safety & Standards Regulations, 2011

Registration is meant for petty food manufacturers that include petty retailer, hawker, itinerant vendor or a temporary stallholder or small or cottage scale industry having annual turnover up to 12 lacs.

Above all, any food businesses having income more than this limit are required to take a license.

FSSAI Registration process

Based on the scale, size and nature of the business, Food Business Operators should obtain the necessary registration or license such as registration/ basic license, central license, and state license.

Types of Registration

Central License: Large food business

State licence: Medium Food Business

Registration: Smale food business

Registration Process

Every petty food business operator shall register their business with the

Registering Authority by submitting an application along with a fee of Rs. 100/-

Firstly, fill the application form A with Fees of Rs. 100/-

Secondly, Generate the Unique Application Reference Number.

Thirdly, Registering Authority (RA) may grant or reject the registration,

with reasons to be recorded in writing within 7 days of receipt of an application for registration.

Fourthly, If granted, Food Business Operator may start the Business.

If necessary, RA may issue a notice for inspection.

Fifthly, Inspection is done within 30 days

Finally, Registration granted FBO may start the business

Fees for Registration Certificate

New Registration Certificate – INR100/year

Renewal of Registration Certificate- INR100/year

Duplicate of Registration Certificate- 10%

FSSAI Central license

FSSAI regional offices issue Central licence to eligible food business operators

like importers, manufacturers, operators in Central  Government Agencies, airport, seaport, etc.

Central Authority issues an application for Central Licence.

But modification, renewal, request for duplicate can be done Online.

Eligibility For Central License

Manufacturer

  1. Dairy units including milk chilling units equipped to handle or process: More than 50,000 litres of liquid milk/day Or 2500 MT of solid per annum
  2. Vegetable oil processing and units producing vegetable oil by the process of solvent extraction and refineries including oil expeller unit: More than 2 MT/day
  3. Slaughtering units: Large Animals ( more than 50) per day, Small Animals (150 or more ) per day, Poultry Birds (1000 or more) per day
  4. Meat processing unit: more than 500 kg of per day  or 150 MT per annum
  5.  All food processing units including relabelled & repackers: More than 2 MT/ day except grains, cereals and pulses milling units.
  6.  Proprietary foods: More than 2 Mt/day
  7. 100% Export Oriented Units: All

Importers

  1. Importers importing food items including food ingredients and additives for commercial use

Other Businesses

  1. Storage (Except Controlled atmosphere and Cold): Capacity more than 50,000 MT
  2. Storages (cold/ refrigerated) : Capacity more than 10,000 MT
  3. Storage (controlled Atmosphere +Cold): Capacity more than 1000 MT
  4. Wholesaler: Turnover greater than 30 crores
  5. Retailer: Turnover greater than 20 crores
  6. Distributor: Turnover greater than 20 crores

Food Catering Services in the establishment and units under Central Government Agencies and Airport, Seaport, etc..: Food Catering Services at Seaport located at Kandla, Tuticorin, Vishakhapatnam, Kolkata, Marmagoa, Cochin,  Mumbai, Chennai, JNPT Or Airport located at Kolkata, Tiruchy, Mumbai, Delhi, Chennai, Amritsar, Cochin, Bengaluru, Hyderabad, Trivandrum, Ahmedabad.

New License: INR 7500/ year

Renewal license: INR 7500/ year

Modification License: INR 7500/ modification

Duplicate License: 10% of the Applicable License Fee

Documents needed for New application

  1. Form B filled and signed by the proprietor/ partner or the authorised signatory
  2. Blueprint/ layout of the processing unit showing the dimensions in meters and operation wise area allocation (mandatory for manufacturing  and processing units only)
  3. List of Directors/ Partners/ Proprietor/ Executive Members of Society/ Trust with full address and contact details (mandatory for manufacturing and processing only)
  4. Name and list of equipment and Machinery along with the number, installed capacity and horsepower used mandatory for manufacturing  and processing units only)
  5. Photo i.d and the address proof issued by Government authority of proprietor / Partner/ Director(s) Authorised Signatory. (optional)
  6.  List of food category to manufacture. (In case of manufactures)
  7. Authority letter with name and address of the responsible person nominated by the manufacturer along with the alternative responsible person indicating the powers vested with them viz assisting the officers in inspections, collection of samples, packing and dispatch. (for manufactures/ processors)
  8. Analysis report ( Chemicals &  bacteriological) of water to be used as an ingredient in food from a recognized/ public health laboratory to confirm the portability (mandatory only for manufacturing and processing units only)
  9. Proof of possession of premises. ( sale deed/ Rent agreement/ Electricity bill, etc.) (optional)
  10. Partnership Deed/ Self Declaration for Proprietorship/ Memorandum & Articles of Association towards the constitution of the firm (optional)- For MoA- Three pages need to be uploaded (First page- Certification of incorporation, Second page – Authorization of food business activity and  Third page – list of directors with addresses)
  11. Copy of the certificate obtained under Coop act- 1861/ Multi-State Coop Act- 2002 in case of Cooperative. (wherever applicable)
  12. NOC & Copy of licence from the manufacturer ( mandatory for relabelled and repackers only)
  13. Food Safety Management System plan or certificate (if any)
  14. Source of milk or procurement plan for milk including the location of milk collection centre etc. in case of Milk and Milk Products processing units ( wherever applicable)
  15. Source of raw material for meat and meat processing plants.

State Licensing

Eligible Food Business Operators (FBO) for example, manufacturers, storage, transporters, retailers, marketers, distributors, etc. Need to register there License from the State Authority

Moreover, depending upon the eligibility FBO may fall under State License after going through the eligibility criteria, fee structure, documents.

Eligibility for State License

Manufacturer

  1. Dairy units including milk chilling units equipped to handle or process: 501 to 50,000 litres of liquid milk/day Or 2500 MT of solid per annum
  2. Vegetable oil processing and units producing vegetable oil by the process of solvent extraction and refineries including oil expeller unit: Upto  2 MT/day and turnover above 12 lakh
  3. Slaughtering units: Large Animals ( more than 2 up to 50) per day, Small Animals ( more than 10 to 150) per day, Poultry Birds ( more than 50 to1000/ day)
  4. Meat processing unit: Up to 500 kg per day  or 150 MT per annum
  5.  All food processing units including relabelled & repackers: More than 100 kg/ ltr to2 MT/ day except grains, cereals and pulses milling units.

Other Businesses

  1. Storage (Except Controlled atmosphere and Cold): Capacity upto50,000 MT
  2. Storages (cold/ refrigerated) : Capacity up to 10,000 MT

  12. Restaurant: Turn over up to 20 crores
  13. Transporter: Having up to 100 vehicle/ wagon Or Turn over up to30 crores
  14. Marketer: Turn over up to 20 crores

Premises in Central Government

  1. Food Catering Services in the establishment and units under Central Government Agencies like Railways, Air and Airport, Seaport, Defence etc..: Food Catering Services in Seaport/ airport excluding Seaport located at Kandla, Tuticorin, Vishakhapatnam, Kolkata, Marmagoa, Cochin,  Mumbai, Chennai, JNPT Or excluding Airport located at Kolkata, Tiruchy, Mumbai, Delhi, Chennai, Amritsar, Cochin, Bengaluru, Hyderabad, Trivandrum, Ahmedabad.

Fees for State License

New License

Manufacture/ miller

Above 1 MT/ day production – Rs 5000/ year

10,000 to 50,000 Ltrs/day of milk Or 501 to 2500 MT of milk solids/ annum – rs 5000/ Year

Below 1 MT of Production – Rs. 3000/ year

501 to 10,000 Ltrs/day of milk or 2.5 MT of milk solids/annum- Rs. 3000/ year

Hotels up to 4 star – Rs 5000/ year

All Food Service Providers including restaurants/ boarding houses, clubs etc. serving food, Canteens ( Schools Colleges, Office, Institutions), Caterers, Banquet halls with food catering arrangement, food vendors like dabbawallas etc & Other food business Operator- Rs. 2000/ year

Renewal of License

The fees for the renewal of a license depends on the number of years selected.

Modification of licence

The fees for modification of the license is fees for one (1) year per license modification.

Duplicate of License

10% of the applicable license fee

Registration

Eligible Food Business Operators (FBO) for example,  manufacturers, storage, transporters, retailers, marketers, distributors, etc.

Likewise, need to register there License from the State Authority

Depending upon the eligibility FBO may fall under registration after going through, for instance, the eligibility criteria, fee structure, documents.

Thus, FSSAI  lays down the eligibility criteria for food business operators under a different kind of business.

Eligibility for State License

Manufacturer

  1. Dairy units including milk chilling units equipped to handle or process: Upto 500 LPD of milk Or 2.5 MT of solid per annum
  2. Vegetable oil processing and units producing vegetable oil by the process of solvent extraction and refineries including oil expeller unit: Turnover up to 12 lakhs/ annum
  3. Slaughtering units: Large Animals  up to 2/ per day, Small Animals up to 10 / per day, Poultry Birds upto50 to/ day
  4. Meat processing unit: Turnover Up to 12 lakhs/ annum
  5.  All food processing units including relabelled & repackers: Turnover not exceeding Rs. 12 lakhs and whose production capacity of food does not exceed 100 kg/ ltr per day

Other Businesses

  1. Storage (Except Controlled atmosphere and Cold): Turnover up to 12 Lakhs/ annum
  2. Storages (cold/ refrigerated) :Turnover up to 12 Lakhs/ annum
  3. Storage (controlled Atmosphere +Cold):Turnover up to 12 Lakhs/ annum
  4. Wholesaler: Turnover up to 12 Lakhs/ annum

CONCLUSION

FSSAI license is mandatory for all businessmen before starting any food business. Consequently, all manufacturers, traders and restaurants who are involved in the food business should obtain a registration or a license number./fssai/

This step has been taken by the Government to ensure that food products undergo certain quality checks before reaching consumers and is safe to be consumed.

Therefore reducing the instances of adulteration, sub-standard products and to improve accountability of manufacturers by issuing a food service license to them.
