Ownership transfer of a vehicle in case of  Normal Sale

In case of normal sale, ownership transfer of vehicle.

  • Where the ownership of a motor vehicle is transferred, the transferred shall report the fact of transfer in Form 29 to the registering authorities concerned in whose jurisdiction the transferor and the transferee reside or have their places of business.
  • In the case of a vehicle registered within the same state, within fourteen days of the transfer, application for the transfer of ownership of a motor vehicle shall be made by the transferee in Form 30 to the registering authorities, and shall be accompanied by a set of forms given below under Form I
  • In the case of a vehicle registered outside the State, within forty-five days of the transfer, an application for the RC transfer online of a motor vehicle shall be made by the transferee in Form 30 to the registering authorities, and shall be accompanied by a set of forms given below under Form I and Form II
  • Pay appropriate fees and tax as specified in rule 81 of the Central Motor Vehicle Rules 1989

Form II

  • A no-objection certificate (NOC) granted by the registering authority
  • An order of the registering authority refusing to grant the NOC; or
  • Where the NOC or the order, as the case may be, has not received, a declaration by the transferor that he has not received any such communication together with—
    • The receipt obtained from the registering authority; or
    • The postal acknowledgement received from the registering authority where the application for no objection certificate has been sent by post.

Ownership transfer of vehicle on the death of the owner of the vehicle

When a vehicle’s registered owner passes away, the vehicle’s ownership is transferred to the deceased registered owner’s legal heirs. Furthermore, when the owner of a motor vehicle dies, the person who inherits the vehicle may, for a period of three months, use it.

You can use the vehicle as it was transferred to you if you notify the registering authority of the owner’s death and his own intention to use the vehicle within thirty days of the owner’s death.

In such a case, the first legal heirs/the person succeeding in the possession of the vehicle should apply for RC transfer online or transfer of ownership with the following documents.

  • Registration certificate in original
  • Form 30 & Form 31 in duplicate with the endorsement of the financier if the vehicle is held on hire purchase agreement along with NOC from the financier.
  • Attested copies of the valid insurance certificate.
  • Original copy of the death certificate of the registered owner.
  • Attested copy of valid PUCC.
  • Succession/Survival member Certificate issued by Competent Authority.
  • Affidavit by the applicant to this effect and from the other legal heirs relinquishing their right in favour of the applicant.
  • Attested address proof copy of Applicant.
  • Verification of vehicle on Form 20
  • Attested copy of PAN Card or Form 60 & Form 61 (as applicable)

Guidelines

  • Apply in Form 31 within the period of three months to the registering authority for the transfer of ownership of the vehicle in your name
  • Pay appropriate fee and tax as specified in rule 81 of the Central Motor Vehicle Rules 1989

  • Form 32
  • Registration certificate
  • Insurance certificate
  • Certificate or order confirming the sale of the vehicle in his favour duly signed by the person authorised to conduct the auction; and
  • Certified copy of the order of the Central Government or State Government authorising the auction of the vehicle

Guidelines

  • The person who has acquired or purchased a motor vehicle at a public auction conducted by or on behalf of the Central Government or a State Government shall apply in Form 32 within thirty days of taking possession of the vehicle to the registering authority
  • Pay appropriate fee and tax as specified in rule 81 of the Central Motor Vehicle Rules 1989

Procedure for Ownership transfer of vehicle

Firstly, visit the RTO where the vehicle was registered.

Secondly, collect the required form mentioned above from the RTO or you can also download in forms

Thirdly, submit the form with documents for the transfer of ownership within 3 months.

Fourthly, pay the  two wheeler / four wheeler or any vehicle ownership transfer fees, fees charged. and receive the receipt.

Fifthly, you will receive the registration of the vehicle under your name by post.
