Court marriage documents
The list of court marriage documents will help you get married in court under the marriage act of India.
You need to submit all the documents when you file a notice of intent to the registrar’s office. At the last step of the process, both parties sign the declaration in the presence of the registrar and witnesses.
But if want to solemnize the marriage elsewhere then under section 12 of the special marriage act you can do this. And get a marriage certificate.
Document Required For Court Marriage
1. Duly filled application form:
To apply for the court marriage you need to pay a nominal fee to the cashier of the district. And keep the required court marriage documents handy.
Attach the receipt for the fees you paid to the application form. The fees are Rs. 100 if you are getting married in the Hindu marriage act. And if the special marriage act then fee is Rs. 150.
2. Proof of date of birth:
As the proof of date of birth for court marriage documents you can submit any of the following:
- Birth certificate
- Passport
- Matriculation certificate
This proof needs to submit by both parties. If you are submitting a passport then make sure it should not be expired.
3. Address proof:
It is the documentation of the fact that either one or both parties have resided in the district for more than 30 days. For the address proof you can submit the following documents:
- Ration card
- Aadhar card
- Voter id card
- Passport
4. Affidavits from both parties separately stating:
This affidavit needs to be 3 things clear- date of birth, marital status, and an affidavit of fact.
5. Passport-sized photos of both parties:
The photos need to be recent. And duly attached with a gazetted officer for them to qualify the application form.
6. In the case of windows:
The death certificate of the spouse needs to submit with other court marriage documents.
7. In the case of divorce:
The decree or the order of divorce needs to submit with other court marriage documents.
8. Address proof of witnesses:
You need 3 witnesses for the court marriage. The witness needs to submit their address proof as one of the given below.
- Ration card
- Aadhar card
- Voter id card
- Passport
9. Pan card of the witnesses:
The witnesses need to also carry their pan cards for the solemnization of the marriage.

Process of court marriage
The process of court marriage is simple and easy. Basically, the process is divided into 4 steps. All the steps are explained below:
1. Notice of intended marriage:
The first step for the court marriage is 30 days prior notice to the registrar. The notice should be in the format given in section 5 of the special marriage act.
2. Publication of objection:
After receiving a notice registrar put in to display the notice for any objection against it. If there are no objections to the notice, the process will continue. If there are objections and they are valid, the court marriage will not proceed.
3. Sign of declaration:
Then both parties and witnesses need to sign the declaration form in the presence of the registrar. The declaration state that both parties are proceeding with court marriage with their consent.
4. Marriage certificate:
After completion of all the formalities registrar specify all the details of a court marriage certificate. The issuance of the certificate takes 15-30 days.
