Ownership Transfer of Vehicle Delhi

RC transfer process in Delhi is now partially online, making it more streamlined for applicants. You can fill out the application and pay the required fees online through the official Parivahan portal. However, the process still requires physical submission of documents. Once the online steps are completed, the signed application forms along with supporting documents must be sent to the concerned RTO 

Following are the steps for RC transfer in Delhi : 

• Visit the official website of parivahan
• Select ‘Vehicle related Services’
• Select ‘State’ and input the ‘RTO number’, then click ‘Proceed’
• Select ‘Apply for Transfer of Ownership, Change of Address, Hypothecation [Addition/Continuation/Termination], Duplicate RC)’
• Enter your vehicle details as a Vehicle Registration No. and the last five characters of chassis number
• Fill up the application detail carefully
• Deposit Requisite RTO fees online
• Take print of form 29, form 30 & RTO fees receipt
• Send signed application forms along with supporting documents to the concerned RTO through speed post.
• Application will be scrutanized and processed
• You will get new RC in the name of buyer after one month 

Following is the RC transfer fees in Delhi :

Additional fee of Two Hundred Rupees shall be levied if the certificate of registration is a smart card type issued

If transfer of vehicle ownership in Delhi is happening from individual to individual name, following are the documents required :

• Original RC 
• Dully filled Form no.29
• Dully filled Form no.30
• Copy of valid insurance
• Copy of Aadhar card of buyer (Address on Aadhar should be of Delhi only & Mobile no. should be updated on it)
• Copy of Aadhar card of Seller (Address on Aadhar should be of Delhi only & Mobile no. should be updated on it)
• Copy of valid pollution under control certificate
• Copy of G.I.R./Pan no. or Form no. 60/Form no. 61 (in case of cars only)
• Bank NOC and 2 nos of form 35 ( In case vehicle was under loan or hypothecation)

• Not transferring RC is an offence under the Motor Vehicles Act.  
• Seller remains legally responsible for any challans, accidents, or crimes involving the vehicle until the RC is officially transferred.
•  It is in the seller’s best interest to initiate the RC transfer process immediately after selling the vehicle.

If the buyer fails or refuses to transfer RC, the seller can submit a written complaint to the concerned RTO.

Yes, its necessary to do complete re-payment of loan on the vehicle before selling it .  The transfer of vehicle ownership can not be done if there is Hypothecation on the vehicle in the RTO records . 

Yes, transferring the ownership of a two-wheeler from another state to Delhi is possible, but it involves a two-stage process. First, you need to obtain a No Objection Certificate (NOC) from the vehicle’s parent RTO (the RTO where the bike is originally registered). Once the NOC is obtained, you can proceed with the re-registration and ownership transfer at the RTO in Delhi. Both steps are mandatory for completing the interstate RC transfer legally.

Local address proof is mandatory for RC transfer in Delhi. Aadhar card of the buyer is the only acceptable address proof document. Address on Aadhar should be of Delhi address.

The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.

Documents required for vehicle ownership transfer in case of death is :

• The succession certificate is required for transfer of ownership, if applying other than surviving member. 
• The surviving member certificate is required if nominee is applying for transfer of vehicle.
• The member of family may also submit the NO Objection Certificate in the name of nominee as names are mention in surviving certificate. The members may appear in person before the registering authority as name mention in the surviving certificate. 
• Death certificate and Form 30 duly fill up by nominee and signed.
• Self attested copy of valid vehicle insurance.
• Self attested copy of valid address proof.
• Original vehicle registration certificate.
• NOC and Form 35 from financer / Bank, if the vehicle under Hypothecation agreement.
• Appropriate requisite fee specified in Rule 81 and composite fee if applicable.

No, the registered owner is not required to be present for every step. However, if there is a signature mismatch or any discrepancy in documents, the RTO may ask the registered owner to visit the office for verification.

Legally, both the buyer and the seller have roles in ensuring the ownership transfer is completed, but primary responsibility lies with the buyer after the sale is made.

Seller's Responsibilities:

Initiate the Transfer Process:

• Submit Form 29 to the RTO notifying the sale.
• Provide all documents required (RC, insurance, PUC, etc.).
• Hand over the original RC, insurance, and NOC (if applicable) to the buyer.

Get a Delivery Note or Sale Agreement:

• To protect themselves from any liability after the handover.
• Keep a Copy of All Documents:
• To prove they no longer own the vehicle.

Buyer's Responsibilities:

Apply for Transfer of Ownership:

• Submit Form 30, insurance, ID/address proof, and pay the applicable RTO fees.
• Get the RC updated with their name at the appropriate RTO.

Check for Dues or Pending Challans:

• Clear any road tax dues or fines, if applicable.

Get a New Insurance Policy:

• Or update the existing one with their name.

A vehicle in India can be transferred any number of times, as long as each ownership transfer is properly done at the Regional Transport Office (RTO). As per motor vehicle act, there is no legal limit to how many times a vehicle can change hands.

Yes, its mandatory to transfer vehicle's insurance policy within 14 days from the date of transfer of vehicle. You wont be able to claim insurance in case of accident or damage if you don't have insurance in your name.
