Ownership Transfer of Vehicle Delhi

RC transfer process in Delhi is now partially online, making it more streamlined for applicants. You can fill out the application and pay the required fees online through the official Parivahan portal. However, the process still requires physical submission of documents. Once the online steps are completed, the signed application forms along with supporting documents must be sent to the concerned RTO

As per new RTO procedure in Delhi,  Aadhar of buyer is mandatory for RC transfer procedure in Delhi. Its mandatory that buyer should be having Aadhar of Delhi address. 

If transfer of vehicle ownership in Delhi is happening from individual to individual name, following are the documents required :

• Original RC 
• Dully filled Form no.29
• Dully filled Form no.30
• Copy of valid insurance
• Copy of Aadhar card of buyer (Address on Aadhar should be of Delhi only & Mobile no. should be updated on it)
• Copy of Aadhar card of Seller (Address on Aadhar should be of Delhi only & Mobile no. should be updated on it)
• Copy of valid pollution under control certificate
• Copy of G.I.R./Pan no. or Form no. 60/Form no. 61 (in case of cars only)
• Bank NOC and 2 nos of form 35 ( In case vehicle was under loan or hypothecation)

• Not transferring RC is an offence under the Motor Vehicles Act.  
• Seller remains legally responsible for any challans, accidents, or crimes involving the vehicle until the RC is officially transferred.
•  It is in the seller’s best interest to initiate the RC transfer process immediately after selling the vehicle.

If the buyer fails or refuses to transfer RC, the seller can submit a written complaint to the concerned RTO.

Yes, its necessary to do complete re-payment of loan on the vehicle before selling it .  The transfer of vehicle ownership can not be done if there is Hypothecation on the vehicle in the RTO records . 

Yes, transferring the ownership of a two-wheeler from another state to Delhi is possible, but its two stage process.

• First, you need to obtain a No Objection Certificate (NOC) from the vehicle’s parent RTO (the RTO where the bike is originally registered).
• Once the NOC is obtained, you can proceed with the re-registration and ownership transfer at the RTO in Delhi. 

Local address proof is mandatory for RC transfer in Delhi. Aadhar card of the buyer is the only acceptable address proof document. Address on Aadhar should be of Delhi. 

Yes, PAN card is mandatory for both the buyer and seller for car RC transfer process. It is to comply with the financial tracking regulations. If either of seller or buyer doesnt have PAN card, they can fill up the form 60 in lieu of PAN card. 

If vehicle is registered in other state such as Karnataka , Delhi etc., first you need to get vehicle NOC from the parent state.

Following would be the steps to transfer vehicle from another state to Delhi :

• NOC from parent state
• Re-registration of vehicle in Delhi & payment of Delhi Road tax
• RC transfer in Delhi

For RC transfer valid insurance is required. It can be either in the name of seller or buyer , doesn't matter. However if you buy it in the name of seller later you will have to apply for insurance transfer in your name . Also if insurance is in the name of seller, you will not get claim for insurance in case of accident. So to avoid these complications its advisable to buy insurance in the name of new owner.

The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.

Documents required for vehicle ownership transfer in case of death is :

• The succession certificate is required for transfer of ownership, if applying other than surviving member. 
• The surviving member certificate is required if nominee is applying for transfer of vehicle.
• The member of family may also submit the NO Objection Certificate in the name of nominee as names are mention in surviving certificate. The members may appear in person before the registering authority as name mention in the surviving certificate. 
• Death certificate and Form 30 duly fill up by nominee and signed.
• Self attested copy of valid vehicle insurance.
• Self attested copy of valid address proof.
• Original vehicle registration certificate.
• NOC and Form 35 from financer / Bank, if the vehicle under Hypothecation agreement.
• Appropriate requisite fee specified in Rule 81 and composite fee if applicable.

As per Motor Vehicles Act, a vehicle RC transfer within the same state must be reported to the RTO within 14 days of the sale. If you have brought a vehicle to Delhi from another state, you should submit documents to the RTO within 45 days from the issue date of vehicle NOC form the parent RTO. There is penalty for late submission of the papers to the RTO. 

Normal practice is that buyer pays for cost of RC transfer process. If there are any liabilities such as pending traffic Challan, outstanding road tax , it should be paid by the seller. Since selling or buying vehicle is a commercial transaction , it depends on the mutual understaning while negotiating the price.   It is in the interest of seller to make sure that buyer completes ownership transfer process at the earliest as any untoward incident can cause trouble for the seller. 

A vehicle in India can be transferred any number of times, as long as each ownership transfer is properly done at the RTO. As per motor vehicle act, there is no limit on the number of times vehicle RC transfer is done. 

Vehicle inspection at RTO is not required, if its Intra-state  vehicle ownership transfer. However, if its inter-state ownership transfer then inspection of vehicle at RTO is mandatory during re-registration process.
