    The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

    When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

    In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.

    Documents required for vehicle ownership transfer in case of death is :

    • The succession certificate is required for transfer of ownership, if applying other than surviving member. 
    • The surviving member certificate is required if nominee is applying for transfer of vehicle.
    • The member of family may also submit the NO Objection Certificate in the name of nominee as names are mention in surviving certificate. The members may appear in person before the registering authority as name mention in the surviving certificate. 
    • Death certificate and Form 30 duly fill up by nominee and signed.
    • Self attested copy of valid vehicle insurance.
    • Self attested copy of valid address proof.
    • Original vehicle registration certificate.
    • NOC and Form 35 from financer / Bank, if the vehicle under Hypothecation agreement.
    • Appropriate requisite fee specified in Rule 81 and composite fee if applicable.

    13. Does the registered owner need to be present for every step of the vehicle transfer process?

    No, the registered owner is not required to be present for every step. However, if there is a signature mismatch or any discrepancy in documents, the RTO may ask the registered owner to visit the office for verification.


    14. Who is responsible for changing ownership of a vehicle?

    Legally, both the buyer and the seller have roles in ensuring the ownership transfer is completed, but primary responsibility lies with the buyer after the sale is made.

    Seller's Responsibilities:

    Initiate the Transfer Process:

    • Submit Form 29 to the RTO notifying the sale.
    • Provide all documents required (RC, insurance, PUC, etc.).
    • Hand over the original RC, insurance, and NOC (if applicable) to the buyer.

    Get a Delivery Note or Sale Agreement:

    • To protect themselves from any liability after the handover.
    • Keep a Copy of All Documents:
    • To prove they no longer own the vehicle.

    Buyer's Responsibilities:

    Apply for Transfer of Ownership:

    • Submit Form 30, insurance, ID/address proof, and pay the applicable RTO fees.
    • Get the RC updated with their name at the appropriate RTO.

    Check for Dues or Pending Challans:

    • Clear any road tax dues or fines, if applicable.

    Get a New Insurance Policy:

    • Or update the existing one with their name.


    15. How many times can a vehicle be transferred?

    A vehicle in India can be transferred any number of times, as long as each ownership transfer is properly done at the Regional Transport Office (RTO). As per motor vehicle act, there is no legal limit to how many times a vehicle can change hands.

    16. Is the transfer of the vehicle's insurance policy mandatory?

    Yes, its mandatory to transfer vehicle's insurance policy within 14 days from the date of transfer of vehicle. You wont be able to claim insurance in case of accident or damage if you don't have insurance in your name.
