Hypothecation Termination Gurgaon

Hypothecation cancellation process in Gurgaon is not online completely . Application can be filled online. Fees can be paid online . However physical submission of application forms and supporting documents is required at concerned RTO in Gurgaon.

Following are the steps for HP termination in Gurgaon : 

• Arrange loan closure letter and form 35 from the bank
• Visit the official website of parivahan: https://parivahan.gov.in/parivahan/ 
• Select ‘Vehicle related Services’
• Select ‘State’ and input the ‘RTO number’, then click ‘Proceed’
• Select ‘Apply for Hypothecation Termination’
• Enter your vehicle details such as Vehicle Registration No. and the last five characters of chassis number
• Fill up the application detail carefully
• Deposit Requisite RTO fees online
• Take print of RTO fees receipt
• Submit signed application forms along with supporting documents to the concerned RTO.
• Application will be scrutanized and processed
• You will get new RC after HP removal after one month 

No, You can not submit your application at any RTO. Application for HP  cancellation in Gurgaon should be submitted to the RTO where vehicle is registered.

• Go to online services
• Click on vehicle related services
• Select state as " Haryana"
• Select RTO and proceed
• Go to status
• Click on " know your application status"

Yes, its mandatory to clear the loan and do hypothecation termination before selling the car. Without clearing hypothecation in Gurgaon RTO you can not apply for RC transfer process.

For the application process of RTO hypothecation removal , original RC is required . So, if you have lost your RC , you should apply for duplicate RC first. You can apply for hypothecation termination once you have RC. You can also apply for duplicate RC and HP termination together. 

If the bank from which you had taken loan has been merged with new bank, in that scenario you should contact new bank. The new bank will issue bank NOC and form 35.

Validity of the bank NOC is normally 3 months or 90 days from the date of issue of the form. You should apply for HP termination in the RTO within this 3 months. Once the validity of your bank paper expires, you will have to get fresh bank NOC. Bank may charge processing fees to re-issue loan closure letter.

If a vehicle is purchased on loan from a financier the same could be endorsed in the RTO record of RC. Application for hypothecation should be submitted to the RTO in Gurgaon where vehicle is registered.

Following are the documents required for HP addition in Gurgaon :

• Original RC
• Two copies Form no.34 duly filled (for endorsement of Hypothecation).
• A certificate from financier for having retained full dues from the financier (for deletion case only).
• Self Attested copy of valid insurance.
• Self Attested copy of address proof of the registered owner.
• Self Attested copy of valid pollution under control certificate.
• Prescribed RTO fee.
• Self Attested copy of PAN Card or Form 60 & 61(as applicable)

You can get NOC from bank online. However please note that to remove hypothecation from RC in the RTO you need to submit original hard copy of the bank NOC signed and stamped by the bank along with supporting documents.

So get the original bank NOC and form 35 from the bank.

1. Ownership is still shown under the bank/financer:

   • Your RC (Registration Certificate) will continue to show the financer (bank/NBFC) as the vehicle’s legal owner.

   • Even if you've repaid the loan, the vehicle isn’t fully yours on record until hypothecation is removed.

2. You cannot sell or transfer the vehicle:

   • Selling the vehicle requires a clear RC. Hypothecation must be removed before ownership can be transferred to a buyer.

3. You may face legal/insurance complications:

   • In case of accidents, insurance claims might get complicated since the financier is still listed.

   • Some insurers may deny full claim or settlement if hypothecation details are outdated.

4. Vehicle NOC cannot be issued:

   • If you plan to shift to another state or RTO, the RTO will not issue a No Objection Certificate (NOC) until hypothecation is removed.

5. Delays in re-registration or scrapping:

   • If you want to re-register the vehicle in another state or get a vehicle scrapped, a clean RC is required.

6. Challans or notices may still go to the bank:

   • In some cases, traffic or legal notices might still be directed to the registered owner (bank), causing confusion or delay.

?Vehicle hypothecation from RTO can not be done with soft copy of bank NOC and form 35. Original bank NOC and form 35 is required to apply for hypothecation termination in the RTO. Please contact your bank and get the physical copy of bank NOC and form 35 having original seal and sign of the bank on it. After this you need to submit application for hypothecation termination in the RTO where vehicle is originally registered. 

Yes, you will get new RC after hypothecation removal in Gurgaon. You need to submit original RC in the RTO along with supporting documents to remove hypothecation from RTO. New RC is issued, once process is done in the RTO.
